The
power of the Government to seize assets has been increased
exponentially with this decision. Assets may now be seized prior to a trial and will significantly reduce a citizen’s ability to hire
competent counsel. The NH Constitution provides greater protections
than the US Constitution and there are still statutory protections
afforded to NH citizens, but this decision will put pressure on law
enforcement to be even more aggressive about seizing assets.
Asset
seizure is a huge part of funding the war on drugs. This decision will
allow the government even more power to coerce, railroad and cajole
citizens into pleading guilty.
